This paper explores the use of an ethics framework based on the Public Health Code of Ethics to guide rationing decisions during a pandemic flu crisis involving a shortage of ventilators. While the law provides public health officials with authority to act, public health officials, as community leaders and health department managers, must address complex questions about how they should use their legal authority, how they can ethically justify a particular action, how they should engage community stakeholders in decision making, (...) and how the process of public justification should take place. Recognising the need for a tool that could help public health officials manage ethical tensions in practice, such as allocation of scarce resources, the Public Health Leadership Society led efforts to develop a Public Health Code of Ethics. The 12 Principles in the Code were written to express the general norms implicit in the practice of public health professionals. The Code offers no hierarchical weighting of the different principles and anticipates that weights and specification of the principles would take place in the context of each community through a process of engagement between public health officials and community stakeholders about specific cases. We describe how public health officials can use the Code to guide deliberation in helping communities prepare to address the tragic choices when allocating scarce ventilators in an influenza pandemic. An alleged moral right to informational privacy assumes that we should have control over information about ourselves. What is the philosophical justification for this control? I think that one prevalent answer to this question—an answer that has to do with the justification of negative rights generally—will not do.

In Ethics and the Limits of Philosophy, Bernard Williams is rather severe on what he thinks of as an ethics of obligation. He has in mind by this Kant and W. D. Ross. For many, obligation seems the very core of ethics and the moral realm, and lives more generally are seen through the prism of this notion. This, according to Williams, flattens out our lives and moral experience and fails to take into account things which are obviously important to (...) our lives. Once we take these things into account, what do we do if they come into conflict with some of our moral obligations, as Williams, in his earlier writings on moral luck, thought to be the case. I want here to explore some of these ideas, in a way that I think harmonious with Williams's general bent though not one that I intend as in any way detailed exegesis of Williams's work. (shrink)

On what grounds will the rational man become a Christian? It is often assumed by many, especially non-Christians, that he will become a Christian if and only if he judges that the evidence available to him shows that it is more likely than not that the Christian theological system is true, that, in mathematical terms, on the evidence available to him, the probability of its truth is greater than half. In my essay I try to explore a parallel between Herder and Humboldt and some modern investigations into the origin of language. Herder favors a pan-psychistic account of nature, and he proposes a theory maintaining that only language can do the business to mediate between the abstract reasoning of man and the content delivered to him by his senses. Humboldt, in his turn, prefers a Kantian transcendental analysis of the form of language, the form being dependent on man’s mental activity (...) and therefore dynamical in character. We may summarize this result in the thesis that Herder is speculating on the origin of language whereas Humboldt attempts to give a theory of the origination of language by synthetic acts. Problems connected with a narrative style of theorizing can also be demonstrated by contrasting two modern authors, namely R. G. Millikan and M. Tomasello. (shrink)

In this article we show that it is possible to completely classify the degrees of r.e. bases of r.e. vector spaces in terms of weak truth table degrees. The ideas extend to classify the degrees of complements and splittings. Several ramifications of the classification are discussed, together with an analysis of the structure of the degrees of pairs of r.e. summands of r.e. spaces.

Background Clinical papers so flawed that they are eventually retracted may put patients at risk. Patient risk could arise in a retracted primary study or in any secondary study that draws ideas or inspiration from a primary study. Methods To determine how many patients were put at risk, we evaluated 788 retracted English-language papers published from 2000 to 2010, describing new research with humans or freshly derived human material. These primary papers—together with all secondary studies citing them—were evaluated using ISI (...) Web of Knowledge. Excluded from study were 468 basic science papers not studying fresh human material; 88 reviews presenting older data; 22 case reports; 7 papers retracted for journal error and 23 papers unavailable on Web of Knowledge. Overall, 180 retracted primary papers (22.8%) met the inclusion criteria. Subjects enrolled and patients treated in 180 primary studies and 851 secondary studies were combined. Results Retracted papers were cited over 5000 times, with 93% of citations being research related, suggesting that ideas promulgated in retracted papers can influence subsequent research. Over 28 000 subjects were enrolled—and 9189 patients were treated—in 180 retracted primary studies. Over 400 000 subjects were enrolled—and 70 501 patients were treated—in 851 secondary studies which cited a retracted paper. Papers retracted for fraud (n=70) treated more patients per study (p<0.01) than papers retracted for error (n=110). Conclusions Many patients are put at risk by retracted studies. These are conservative estimates, as only patients enrolled in published clinical studies were tallied. (shrink)

Anyone interested in the morality of suicide reads David Hume's essay on the subject even today. There are numerous reasons for this, but the central one is that it sets up the starting point for contemporary debate about the morality of suicide, namely, the debate about whether some condition of life could present one with a morally acceptable reason for autonomously deciding to end one's life. We shall only be able to have this debate if we think that at least (...) some acts of suicide can be moral, and we shall only be able to think this if we give up the blanket condemnation of suicide that theology has put in place. I look at this strategy of argument in the context of the wider eighteenth-century attempt to develop a non-theologically based ethic. The result in Hume's case is a very modern tract on suicide, with voluntariness and autonomy to the fore and with reflection on the condition of one's life and one's desire to carry on living a life in that condition the motivating circumstance. For a theist, a man's duty is to conform to the announced will of God. Yet a theist who makes this claim about duty is faced with a traditional dilemma first stated in Plato's Euthyphro—are actions which are obligatory, obligatory because God makes them so, or does God urge us to do them because they are obligatory anyway? To take the first horn of this dilemma is to claim that God can of his free choice make any action obligatory or (...) non-obligatory. The critic claims that the theist cannot take this horn, for God cannot make bad actions good. (shrink)

ARGUMENTS FROM DESIGN TO THE EXISTENCE OF GOD MAY TAKE AS THEIR PREMISS EITHER THE EXISTENCE OF REGULARITIES OF COPRESENCE OR THE EXISTENCE OF REGULARITIES OF SUCCESSION. THERE ARE NO VALID FORMAL OBJECTIONS TO A CAREFULLY ARTICULATED ARGUMENT OF THE LATTER TYPE. AGAINST SUCH AN ARGUMENT NONE OF THE OBJECTIONS IN HUME’S "DIALOGUES" HAVE ANY WORTH. THE ARGUMENT MAY HOWEVER GIVE ONLY A SMALL DEGREE OF SUPPORT TO ITS CONCLUSION.

Informed choice is increasingly recognised as important in supporting patient autonomy and ensuring that people are neither deceived nor coerced. In cancer screening the emphasis has shifted away from just promoting the benefits of screening to providing comprehensive information to enable people to make an informed choice. Cancer screening programmes in the UK now have policies in place which state that it is their responsibility to ensure that individuals are making an individual informed choice. There is a need to evaluate (...) whether such policies mean that those people invited for screening are making informed choices, and how comprehensive information affects other variables such as uptake, cost effectiveness, and satisfaction. At the present time, there is no validated measure of informed choice in cancer screening. Such a measure could be used to evaluate the effectiveness of interventions to increase informed choice and levels of informed choice in a population invited for screening. It could encourage health professionals to be accountable. Factors important when measuring informed choice in cancer screening include an individual’s understanding of the limitations of screening, the ability to make an autonomous choice, and the difference between choice and behaviour.
